About Annual Notifications for Parents and Students

ANNUAL PARENT NOTIFICATIONS

The Bear Valley Unified School District provides Annual Parent Notifications, in accordance with California Education Code section 48980, at the beginning of the first semester or quarter of the regular school term, the governing board of each school district must notify parents/guardians of their rights or responsibilities under certain provisions of the Education Code. Other provisions of California and United States law also require notification of parents/guardians.

 

A copy of the Annual Parent Notifications is provided to all new students enrolled in the Bear Valley Unified School District, and is posted on every school site in a prominent location and on the district’s web site. A copy of the current Annual Parent Notifications is provided below in both English and Spanish. A hard copy will be provided upon request and is available at all school sites and the district office:

UNIFORM COMPLAINT PROCEDURES (UCP)

 

The Bear Valley Unified School District has the primary responsibility for compliance with federal and state laws and regulations. We have established Uniform Complaint Procedures (UCP) to address allegations of unlawful discrimination, harassment, intimidation, and bullying, and complaints alleging violation of state or federal laws governing educational programs, the charging of unlawful pupil fees and the non-compliance of our Local Control and Accountability Plan (LCAP).

STUDENT SEXUAL HARASSMENT POLICY

The Bear Valley Unified School District is committed to maintain an educational environment that is free from harassment.  The Governing Board prohibits sexual harassment of students by other students, employees or other persons, at school or at school-sponsored or school-related activities. The Board also prohibits retaliatory behavior or action against persons who complain, testify, assist or otherwise participate in the complaint process established pursuant to board policies and the administrative regulations.

 

The district strongly encourages any student who feels that he/she is being or has been sexually harassed on school grounds or at a school-sponsored or school-related activity by another student or an adult to immediately contact his/her teacher, the principal, or any other available school employee. Any employee who receives a report or observes an incident of sexual harassment shall notify the principal or the district’s compliance officer immediately.

TITLE IX AND NON-DISCRIMINATION

 

Title IX of the Educational Amendments of 1972 prohibits discrimination based on sex in education programs and activities in federally funded schools at all levels.

 

Title IX protects students, employees, and applicants for admission and employment from all forms of sex discrimination, including discrimination based on gender identity or failure to conform to stereotypical notions of masculinity of femininity. In addition, all students (and other persons) are protected by Title IX – regardless of their sex, sexual orientation, gender, identify, part of full time status, disability, race, or national origin – in all education programs and activities.

WILLIAMS COMPLAINT PROCESS AND EDUCATION CODE SECTION 35186

 

Williams and Education Code (EC) Section 35186 created a procedure for the filing of complaints concerning deficiencies related to instructional materials, conditions of facilities that are not maintained in a clean or safe manner or in good repair, and teacher vacancy or misassignment. The complaint and response are public documents as provided by statute.  Complaints may be filed anonymously. However, contact information must be provided if a response is desired.
